These Terms of Service ("Terms") govern your use of the InspectScribe application and related services (the "Service") provided by InspectScribe ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
Plain language summary: InspectScribe helps you draft inspection reports. The AI generates drafts from your recordings and photos. You are responsible for reviewing, editing, and approving every report before it goes to your client. The final report is your professional work product.
1. The Service
InspectScribe is a productivity tool that assists licensed home inspectors with creating inspection reports. The Service includes:
- Voice recording and transcription during inspections
- Photo capture and organization
- AI-assisted generation of draft inspection report findings
- Report editing, review, and approval workflow
- PDF report export and sharing
- Cloud sync and data backup
2. AI-Generated Content and Professional Responsibility
This is important: InspectScribe uses artificial intelligence to generate draft report content. All AI-generated content is a starting point — not a finished product. You must review, edit, and approve every finding before it becomes part of your report.
How AI drafting works
When you record voice memos and capture photos during an inspection, the Service transcribes your recordings and uses AI to organize them into structured findings with titles, descriptions, recommendations, and severity levels. This output is always labeled as a "Draft" within the application.
Your responsibility
You acknowledge and agree that:
- AI output is a draft. All AI-generated content requires your professional review before it can be finalized or shared.
- You are the inspector of record. The final inspection report is your professional work product. You bear sole professional responsibility for the accuracy, completeness, and conclusions of every report you approve and deliver.
- AI may produce errors. AI-generated drafts may contain inaccuracies, omissions, or misinterpretations of your recordings. It is your responsibility to identify and correct any such errors before approving the report.
- AI does not replace professional judgment. The Service does not provide inspection opinions, professional advice, or licensed determinations. It organizes and structures information you provide. InspectScribe does not independently verify conditions, code compliance, or safety issues.
- Nothing is fabricated intentionally. The Service is designed to work only from the recordings and photos you provide. However, you should verify that every finding in a draft accurately reflects your observations.
Export controls
The Service requires you to review findings before enabling report export. You cannot export a final report until you have reviewed the draft. This is a safeguard, not a substitute for careful professional review.
3. Your Account
You must be a legal adult to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
If you use the Service as part of an organization, your organization administrator may have access to organization-level data and settings.
4. Acceptable Use
You agree to use the Service only for lawful purposes related to professional home inspection. You may not:
- Use the Service to generate fraudulent, misleading, or fabricated inspection reports
- Misrepresent AI-generated draft content as your independent professional analysis without reviewing it
- Attempt to circumvent the draft review and approval workflow
- Share your account credentials with unauthorized individuals
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Use the Service in violation of any applicable laws, regulations, or professional licensing requirements
5. Your Data
Ownership
You retain ownership of all content you create using the Service, including voice recordings, photographs, report text, and exported documents. We do not claim ownership of your inspection data.
License to us
You grant us a limited, non-exclusive license to process, store, and transmit your content solely to provide and improve the Service. This includes sending recordings to transcription services and text to AI models for draft generation. We do not use your inspection data to train AI models.
Data handling
Your data is handled in accordance with our Privacy Policy. We use encryption in transit and at rest, implement access controls, and do not sell your data to third parties.
6. Payment and Subscription
The Service is offered on a monthly subscription basis. By subscribing, you agree to pay the applicable fees. All fees are non-refundable except as required by law or as described in our trial and cancellation policies.
Free trial
New accounts receive a 14-day free trial. No credit card is required to start the trial. At the end of the trial, you must subscribe to continue using the Service.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Your data remains accessible for 30 days after cancellation, after which it may be deleted.
7. Limitation of Liability
Plain language: We provide a tool to help you draft reports more efficiently. We are not responsible for the professional content of your inspection reports, and our total liability is limited to what you've paid us.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- No professional liability. We are not a licensed inspection company. The Service is a productivity tool. We do not provide inspection services, professional opinions, or licensed determinations. We are not liable for the professional content, accuracy, or completeness of inspection reports you create, approve, and deliver using the Service.
- No warranty on AI output. AI-generated draft content is provided "as is" without warranty of accuracy, completeness, or fitness for any particular purpose. You are responsible for verifying all AI-generated content before use.
- Service availability. We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, though the offline-first design is intended to minimize disruption.
- Liability cap. Our total liability arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
- Consequential damages. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or professional reputation, regardless of the theory of liability.
8. Indemnification
You agree to indemnify and hold harmless InspectScribe, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service
- Inspection reports you create, approve, and deliver using the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
9. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by InspectScribe and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Your inspection data, reports, and content remain your property (see Section 5).
10. Termination
We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we reasonably determine is harmful to the Service or other users. We will provide notice where practicable.
Upon termination, your right to use the Service ceases. Data stored locally on your device remains accessible to you. We will retain your cloud data for 30 days to allow export, after which it may be deleted.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the application at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in South Carolina. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against InspectScribe.
Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Claims eligible for small claims court may be brought there instead of arbitration.
13. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any proceedings not subject to arbitration shall be resolved in the state or federal courts located in South Carolina.
